Smarty Campbell, convicted by a jury of the January 17, 1973 burglary of the United States Post Office at Ladson, South Carolina, brings this direct appeal from a resentencing pursuant to 28 U.S.C. § 2255 claiming the following three grounds for reversal of his conviction: (1) that the trial court abused its discretion by permitting the governments chemist to qualify as an expert witness; (2) that the trial court erred in denying defendants motion to suppress the tire tool and pieces of an acetylene torch assembly which were taken from defendants automobile trunk as a result of a custodial consent search; and (3) that the trial court erred in denying defendants motion for acquittal. Upon consideration of the record, the trial transcript, appellants brief, appellees brief, appellees motion for summary affirmance and appellants answer thereto, we conclude that the defendants claims are without merit, and summarily affirm the judgment of the district court below.
